Conditions are constantly accessible on the website and will prevail, if necessary, upon other versions.

ARTICLE 2 - Price list and orders on the website

Prices shown on the website are in Euros currency and include all taxes. In case of order towards a country other one than France you are the importer of concerned products. Customs duties or other local taxes either import duties or taxes of State may be due. These rights and sums do not recover from the competence of MISION MISERICORDIA. They will be at your expense and recover from your whole responsibility, both in terms of statements (declarations) and payments in the authorities. Besides, prices do not include the shipping fees.

MISION MISERICORDIA has the right to modify these rates in particular cause of the variation of the prices of its own suppliers. The price indicated in the order confirmation by MISION MISERICORDIA is the final price. Payment itself will be considered as completed only after MISION MISERICORDIA cash the order funds. System of automatic recording is the proof of the nature, the contents and the date of the order.

MISION MISERICORDIA confirms the acceptance of the customer order by email.

The purchase will be completed once the confirmation of the order is done.

MISION MISERICORDIA has the right to cancel order of any customer having a litigation regarding the payment of a previous order. The customer is responsible for the information entered in MISION MISERICORDIA data base, in particular regarding the shipping information. Wrong information given from any buyer at the time of the order engages the responsibility of the buyer itself: in the event of incorrect information in the delivery address, the salesman could not be held as responsible for the impossibility to deliver the product.

Purchase order signed by the consumer by double clicking constitutes an irrevocable acceptance of it. This fundamental rule might be doubted only within the limits of the present general conditions of sale as well as the right to retract and out-of-stock condition. ARTICLE 3 – Payment

Payment is made by credit card. In this case, the payment is made on the site of ATOS Worldline, the bank partner of MISION MISERICORDIA.

ARTICLE 4 - Shipping / Delivery

After the order confirmation MISION MISERICORDIA is engaged to deliver, via the Post office, all the references ordered by the buyer within maximum 3 weeks.

French Post company is contracted with MISION MISERICORDIA to deliver the order to the address that the customer provided to MISION MISERICORDIA.

MISION MISERICORDIA through is committed into making its best efforts to deliver the parcels within the shipping time mentioned above. Time limits are communicated as an indication and could possibly go beyond: cancellations and complaints regarding any damage will be voided.

However, if the ordered products are not delivered within 3 weeks after the indicative date of delivery, for other causes that the ones beyond control; the sale could be cancelled upon a written request from the customer. Sums paid by the customer will be immediately re-credited, without any compensation or reserve. Delivery process is considered as completed as soon as MISION MISERICORDIA remits the goods to the conveyor: eventual delays do not allow the right to the purchaser to claim damages. In case of technical product, the client should check the good shape of the product and read the attached notice.

In case of damage, customer has the right to return the parcels according to the condition mentioned in this document. War, riot, fire, strikes, accidents and impossibility of being delivered are considered as case of absolute necessity. Parcels always travel at the risks and dangers of the recipient, even whether the order is addressed to another recipient. Always check your parcel upon arrival.

Customers have a 48 hours deadline from the delivery day to make a complaint nearby the conveyor in the event of missing product or degradation. At the end of this period, parcels will be considered in conformity and free of very apparent vice. Order can be delivered in several times to the customer with the respective expenses of delivery to the two orders.

ARTICLE 5 - Property Transfer - Risks Transfer

Property transfer of the MISION MISERICORDIA goods will be carried out once the payment completed no matter what is the date of the transaction. On the other hand, transfer of risks of loss and deterioration of MISION MISERICORDIA goods will be placed on the responsibility of the carrier.

ARTICLE 6 - Right to retract

According to the French law, customers have 7 days to retract and to return a product to the supplier at the following address:

Any exchange or refund will be accepted only under the following conditions: products must be returned in their original package and in perfect shape within 10 days since the day of the delivery. Return shipping fees will be on the customer charge.

MISION MISERICORDIA is not responsible for any lost returns, parcel must be sent against signature with acknowledgement of delivery. MISION MISERICORDIA must exchange or refund parcels returned by the customer with no charge except the return one. Refunding is due within a maximum of 1 month. Please take that parcels sent without its original accessories, damaged parcels and dirty parcels won’t be accepted.

ARTICLE 7 - Responsibility of the supplier - Guarantee

1. MISION MISERICORDIA assumes the responsibility relative to the goods and to protect customers against reclamation and judiciary request in link with damages caused to the goods or human bodies.
2. MISION MISERICORDIA also guarantees, in accordance with the legal provisions, the customer against hidden vice affecting the delivered products or the services provided and making them inappropriate and useless. In order to take advantage of its rights, customers will have to inform the Supplier, stated in written reclamation, about the existence of any vice within maximum 10 days. MISION MISERICORDIA cannot be held as responsible about the consequences that the damage could involve to the customer and only guarantees the replacement of parcels.
3. Products presented on the website are in conformity with the regulation in force in France. The customer is only responsible for the choice of the articles, their conservation and their use.
4) MISION MISERICORDIA is not responsible regarding any delay or cancellation relating to an absolute necessity usually recognized by French law.

ARTICLE 8 - Data Processing

Regarding the French law n° 78-17 of January 6, 1978, it is recalled that personal information and data requested by MISION MISERICORDIA are necessary in order to complete the customer orders and are only dedicated to an internal use. However, these information might be transferred to MISION MISERICORDIA partners or suppliers. Customers have a right of access, modification, correction and opposition about their personal information which must be communicated by mail to MISION MISERICORDIA Company.

ARTICLE 10 - Litigations

This contract is subject to the French Law. MISION MISERICORDIA cannot be held as responsible for any nature of charge either material or physical which could emanate of a bad use of the commercial goods. MISION MISERICORDIA liability will be limited to the amount of the order and won’t be doubted regarding simple and casual mistakes due to the presentation of its products despite all the efforts to maintain the high quality of goods. Customers have the possibility to seek a cordial and friendly agreement with MISION MISERICORDIA before any sue action, especially thanks to a Customers lobby.

The period to get an agreement may not cancel the short time of the legal guarantee or the length of the contracted guarantee. It is understood that customers have to respect their financial obligations toward the company.
Complaints and reclamations will always be received with a particular attention and will be completed in the best delay. In case of litigation, customer will first try to find solutions with the MISION MISERICORDIA Company in order to find out a friendly agreement. Otherwise, the French Court of Commerce is the court which adjudicates, no matter what is the place of delivery or the way of payment is accepted.
